Terms of service.
These are the terms that apply when you use bloomwired.io, our free tools, or hire us to build something. Written in plain language. If anything here is unclear, email us at [email protected] before agreeing to a project and we will explain.
Accepting these terms
By using bloomwired.io or hiring us for a project, you agree to these terms. If you do not agree, please do not use the site or engage us as a service provider. If you are signing on behalf of a company, you confirm that you have the authority to bind that company to these terms.
If a separate written agreement (a project proposal, statement of work, or signed contract) covers your engagement with us, that agreement controls where it differs from these terms.
About Bloomwired
Bloomwired is a two-person systems shop run by Ary and Brixon. We build and clean up the systems behind forms, booking, follow-up, and lead routing for service businesses. Our work runs primarily on GoHighLevel. When you hire us, you are working directly with one of us, not a sales team.
Who can use the site
You must be at least 18 years old (or the age of majority where you live) to use the site or hire us. The site is designed for business owners and the people who help them. Do not use it on behalf of anyone under 18.
What we do
Our paid services are described on the offers page at bloomwired.io/offers. Each engagement starts with a Setup Check, where we look at what you have, and ends with a fixed-price proposal for the work we recommend. Unless your proposal says otherwise:
- The scope is what is written in your proposal. Anything not listed is out of scope
- Timelines are estimates based on us getting timely answers and access from you
- The build runs in your GoHighLevel sub-account or a comparable platform we agree on
- We hand over working systems plus a short walkthrough of how they run
Free tools and content
The free tools (System Snapshot, Site Audit, Cost Calculator, and so on), the blog, and any other content on the site are provided as is, for general information and rough self-assessment. They are not a substitute for advice specific to your business. Results are estimates. Do not make a major business decision based only on what a free tool tells you.
You are welcome to use the tools, screenshot the results, and quote the blog with attribution. You may not republish the tools, copy the content wholesale, or sell access to anything we publish for free.
Quotes and proposals
A quote or proposal we send you is valid for 30 days from the date on the document, unless that document says otherwise. Quotes are based on the scope and information available at the time. If the scope changes, we will adjust the quote in writing before we start work on the new piece.
Sending a quote is not an offer to enter a contract. A contract is formed only when you accept the proposal in writing and pay any required deposit.
Payment, refunds, late fees
Deposit and payment schedule
Unless your proposal says otherwise, fixed-price projects require a 50% deposit before we start. The balance is due on delivery. We send invoices and accept card or, where available, bank transfer.
Digital products (books and templates)
Some things we sell are digital downloads, like the Never Lose a Lead Again book and its templates. Because you get the full file and the private template vault right after paying, these sales are final and non-refundable. You buy the same thing everyone else does, and you can read a free chapter before you decide, so please make sure it is what you want before you check out. If a download link ever fails or you were charged twice, email [email protected] and we will fix it. If you later hire us for a build, the price you paid for the book comes off the price of that build.
Refunds on project work
If you cancel a project after the deposit but before we have started building, we refund the deposit minus a 15% administrative fee. Once build work has started, deposits are non-refundable, but we will deliver what we have completed and document anything left open so another provider can continue.
Late payment
Invoices are due on the date stated on the invoice. Balances unpaid more than 14 days past due may pause work on your project and accrue a late fee of 1.5% per month on the outstanding balance, where allowed by law.
Taxes
Prices do not include sales tax, GST, HST, VAT, or other taxes unless explicitly stated. You are responsible for any taxes that apply to the engagement.
Your responsibilities as a client
For us to deliver on time and on scope, we need a few things from you:
- Timely access to your GoHighLevel account, calendar tool, payment processor, and any other systems we are touching
- Responses to questions within a reasonable time (typically 2 business days)
- Honest information about what you currently use and what is broken
- Final approval on copy, branding, and anything we cannot reasonably assume
Delays caused by missing access or slow responses may extend the timeline and, in some cases, increase the cost.
Intellectual property
What you own
You own the configured systems, copy, and assets we deliver for your business, once paid in full. That includes the workflows, forms, automations, and any custom content created specifically for your project.
What we keep
We retain the rights to our own internal frameworks, templates, code snippets, and general know-how we use across clients. You receive a perpetual, royalty-free licence to use anything we build for you. We may reuse, refine, and apply our frameworks to other projects.
The Bloomwired brand
The Bloomwired name, logo, blog content, free tools, and site design are ours. Do not copy or republish them without written permission.
Showing the work
Unless you tell us in writing that your engagement is confidential, we may mention publicly that we worked together, show non-sensitive screenshots, and write anonymized case studies. We will never share your client list, financials, or anything we have agreed in writing to keep private.
Confidentiality
We treat the information you share during an engagement (your client list, pricing, internal processes, anything not already public) as confidential. We do not share it with anyone outside the Bloomwired team without your permission, except when required by law. The same goes both ways: please do not share our proposals, pricing, or internal documentation with anyone outside your team.
This obligation continues for two years after the engagement ends.
Disclaimers and limitation of liability
The site, the free tools, and the services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific results such as a number of leads, a revenue increase, or a conversion rate. Results depend on factors outside our control, including your offer, audience, market, and ongoing operations.
To the maximum extent allowed by law, Bloomwired and its team will not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption. Our total liability for any claim arising out of or relating to the site or our services is limited to the amount you paid us for the specific service that gave rise to the claim during the 12 months before the claim arose.
Nothing in these terms limits liability that cannot be limited under applicable law, including for fraud or willful misconduct.
Termination
Either of us can end an engagement at any time. If you end the engagement, the rules in section 07 apply. If we end the engagement (for example, because of non-payment, breach of these terms, or behavior we consider abusive), we will give you at least 7 days written notice where reasonable and document what is left so you can move on cleanly. Sections that by their nature should survive termination (intellectual property, confidentiality, disclaimers, governing law) survive.
Governing law
These terms are governed by the laws of the jurisdiction where Bloomwired is established, without regard to its conflict-of-law rules. Any dispute that we cannot resolve by good-faith conversation will be brought in the courts of that jurisdiction. You and Bloomwired agree to first try to resolve any dispute by direct email or call for at least 30 days before starting any formal action.
Changes to these terms
We may update these terms from time to time. The "last updated" date at the top will reflect the most recent change. Material changes will be highlighted at the top of the page for at least 30 days. If you continue to use the site or our services after a change, you accept the updated terms. If you do not agree, stop using the site and let us know in writing.
Text messaging (SMS) terms
Who is sending you messages
Bloomwired is a two-person systems shop run by Ary and Brixon. If you give us your mobile number and opt in to receive text messages, the sender of those messages is Bloomwired. Messages are tied to real work we are doing together and to conversations you started, not to bulk marketing lists.
What messages you may receive
You may receive booking confirmations, appointment reminders, project updates, reply notifications when we respond to your inquiry, invoice or payment reminders, and other account-related or transactional messages. We do not send promotional broadcasts.
How you gave consent
You give consent to receive text messages by entering your mobile number into one of our forms and checking the SMS opt-in box, or by explicitly agreeing to text communication over email or in writing. Consent to receive text messages is never required to purchase our services or use the site.
Opting out
You can opt out at any time by replying STOP to any message from us. You will receive a single confirmation message acknowledging that you have been unsubscribed, and no further texts after that.
Getting help
Reply HELP to any message and you will receive a short reply with support contact information. You can also reach us directly at [email protected].
Message frequency
Message frequency varies based on active work. Most people receive fewer than five messages per week, and only during the life of a project or an active conversation.
Carrier disclaimer
Carriers are not liable for delayed or undelivered messages.
Cost of messages
Standard message and data rates may apply. Check with your mobile carrier for details.
Privacy
How we handle your mobile number and messaging consent is covered in our Privacy Policy. Mobile information and SMS opt-in data are never shared with third parties or affiliates for marketing or promotional purposes.
